Sandy Hook Plaintiffs Lose Bid to Stall Remington Bankruptcy

On Tuesday Judge Clifton Jessup Jr., of the U.S. Bankruptcy Court of the Northern District of Alabama, ruled against a motion to delay Remington’s bankruptcy proceedings. The plaintiffs in the hearing—a group comprised of a survivor and families of the 2012 Sandy Hook tragedy—claimed the speed of the auction jeopardized their lawsuit against the gun manufacturer that alleges it should have never sold the Bushmaster and its marketing deliberately targeted, “…younger, at-risk males…, ” according to Fox Business news. They have until Sept. 1 to appeal this week’s decision.

If it goes unchallenged or withstands review, Remington’s assets will go on the auction block as early as Sept. 17. The sale will recover some of the $100 to $500 million it owes to creditors, which number between 1,000 and 5,000 companies and individuals, according to the bankruptcy filing. The Sandy Hook plaintiffs are not included in the bankruptcy protection paperwork filed by Remington.

Plaintiff’s Claim

CNBC reports the plaintiffs alleged the speed at which the bankruptcy was proceeding could, “prevent Remington from ever answering for its role in the wrongful marketing of the weapon and that marketing’s causal role in the devastating loss of life at Sandy Hook Elementary School.” Their attorney told the judge on Tuesday, “There won’t be, there simply can’t be, a full and fair process unless this high-speed train that we’re on slows down.”

AL.com reports the judge arrived at this week’s decision because, “…the bankruptcy court was not the proper venue to resolve the claims by the families.” The Fox Business News story also indicates he expressed displeasure that the stalling motion would buy more time for the plaintiffs to scour disclosure documents related to a separate lawsuit filed in Connecticut against Remington.

NRA Praises Bernhardt’s Historic Hunting and Fishing Expansion

Part of maximizing the accuracy and functionality of any rifle system is properly fitting it to the shooter. The Threaded Bolt Handle is more ergonomic than the factory handle. It is swept back further and places the bolt knob is a position that makes it easier and faster to work the action. The end of the Threaded Bolt Handle also has 5/16”-24TPI threads. This enables a significant degree of improvement with any of the Anarchy Outdoors aftermarket bolt knobs with the same threads. Precision machined from 17-4 stainless steel and now available in a satin or black nitride finish, the Threaded Bolt Handle for the TC Compass and Venture has an MSRP of $59.99.

 The Anarchy Outdoors Picatinny scope base for the T/C Compass and Venture features an integral bubble level that is machined into the back of the rail. Armed Citizen Stops Four Home Invaders

One of the four home invaders who broke into a Garden City, AL-house early in the morning on Aug. 17 was shot after an exchange of gunfire with the residents, according to the Trussville Tribune. Two others were arrested by responding officers from the Hanceville Police Department and Cullman County Sheriff’s Office. A fourth suspect was caught later.

“This is a great example of citizens utilizing their Second Amendment rights and protecting themselves and their family,” Cullman County Sheriff Matt Gentry said in a news release on the incident “I have often stated that law enforcement can be minutes away when you only have seconds to defend yourself and your family. That’s why we at the sheriff’s office are proponents of not only having a weapon for self-defense but also being proficient in how to use it.”

Charges have yet to be leveled against the suspect hospitalized with a gunshot wound, according to AL.com, but the news outlet reports those the others face include, “…first-degree burglary, first-degree robbery, trafficking of illegal drugs, unlawful possession of marijuana and unlawful possession of drug paraphernalia.”

Sheriff Gentry is not the only law enforcement officer to recently state his support for law-abiding citizens using a firearm to defend themselves against a felonious attack. When a citizen shot and killed an armed home invader in Florida on Aug. 8 Pasco County Sheriff Chris Nocco posted a video to Facebook explaining, “He was defending himself and his family. Any loss of life is tragic, but the victim was utilizing his Second Amendment Rights to protect himself and his family…when their lives were on the line, when that door was being kicked in, they utilized their Second Amendment rights, and they’re safe because of it.”
